Please read these Terms of Service carefully before using any services or products offered by Molua's Pharmacy. By visiting our pharmacy, using our services, or interacting with our digital platforms, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Molua's Pharmacy ("we," "us," or "our"), governing your use of our pharmacy services, products, digital platforms, and any related services.

By entering our premises, purchasing products, consulting with our pharmacists, or using our digital tools and management systems, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use our services.

These Terms apply alongside our Privacy Policy, which is incorporated herein by reference.

2. Description of Services

Molua's Pharmacy provides the following services and products:

Pharmaceutical Services

  • Dispensing of prescription and over-the-counter (OTC) medications
  • Prescription verification and processing
  • Medication counselling and pharmacist consultations
  • Chronic disease medication management (diabetes, hypertension, etc.)
  • Drug interaction screening and allergy checks

Products

  • Prescription medications (requiring a valid prescription)
  • Over-the-counter medicines and health supplements
  • Baby and mother care products (formula, prenatal vitamins, etc.)
  • Cosmetics, skincare, and personal hygiene products
  • Medical devices and health equipment

Digital Services

  • Pharmacy management system accessible by authorised staff
  • Purchase receipts and dispensing records
  • Digital communication and notifications (with consent)

3. Eligibility

Our pharmacy services are available to all members of the public. However, the following conditions apply:

  • Age: Customers under the age of 18 purchasing prescription medications must be accompanied by a parent or legal guardian, or present written authorisation from a legal guardian where permitted by applicable law.
  • Prescription requirement: Prescription-only medications will not be dispensed without a valid, current prescription issued by a licensed healthcare practitioner authorised to practice in Cameroon.
  • Accurate information: You agree to provide accurate, complete, and truthful information when requesting services, including your identity, health history, and prescription details.
  • Staff access: Access to our digital pharmacy management system is limited to authorised staff members of Molua's Pharmacy. Unauthorised access is strictly prohibited and may result in legal action.

4. Prescription Medications Policy

The dispensing of prescription medications is governed by the pharmaceutical laws of Cameroon and the professional standards of our licensed pharmacists. You agree to the following:

  • Valid prescriptions only: We will only dispense prescription medicines upon presentation of a valid, legible prescription from a licensed and registered healthcare practitioner. Prescriptions must include the patient's name, date, medication name, dosage, duration, and the prescriber's signature and registration number.
  • No prescription fraud: Attempting to obtain prescription medications through falsified, altered, or forged prescriptions is a criminal offence under Cameroonian law. We will report suspected fraud to the relevant authorities.
  • Controlled substances: Medications classified as controlled substances are subject to stricter dispensing requirements. We reserve the right to request additional identification and retain a copy of the prescription as required by law.
  • Partial dispensing: Where a full course of a prescription is not available in stock, we may dispense a partial quantity. We will notify you and facilitate the collection of the remainder as soon as possible.
  • Right to refuse: Our pharmacists reserve the professional right to decline to dispense any medication where they have reasonable clinical or ethical concerns, in accordance with their professional obligations.

5. Health Information Disclaimer

Our pharmacists are qualified healthcare professionals who provide general medication guidance and counselling as part of our pharmaceutical services. However, please note the following:

Important Notice

Information provided by our pharmacists constitutes pharmaceutical advice and is not a substitute for a medical diagnosis or a consultation with a licensed physician. Always consult your doctor for diagnosis, treatment planning, and any medical decisions.

  • Any health information shared on our premises, in written materials, or through our digital platforms is for general informational purposes only.
  • We do not diagnose medical conditions, prescribe treatments, or provide medical opinions. These are the exclusive domain of licensed medical practitioners.
  • In a medical emergency, call for emergency medical assistance immediately. Do not rely solely on pharmacy advice in emergencies.
  • Never disregard professional medical advice or delay seeking it because of something you have read in our materials or heard from our staff.

6. Payments & Refund Policy

Payment

  • All prices are displayed in Central African Francs (FCFA) and are inclusive of applicable taxes.
  • We accept cash, mobile money (MTN Mobile Money, Orange Money), and other payment methods displayed at the point of sale.
  • Payment is due in full at the time of purchase. We do not offer credit or deferred payment arrangements unless a formal agreement has been executed.
  • A valid receipt will be issued for every transaction. Please retain your receipt for warranty and return purposes.

Returns & Refunds

  • Dispensed prescription medications: For patient safety and regulatory reasons, prescription medications that have been dispensed generally cannot be returned or refunded once they leave the pharmacy, except where a dispensing error has occurred on our part.
  • OTC products and general items: Unopened OTC products in original, undamaged packaging may be returned within 7 days of purchase with a valid receipt, provided there are no health or safety concerns.
  • Defective or damaged products: If you receive a product that is defective, damaged, or does not match its description, please return it with your receipt within 14 days and we will offer a replacement or refund.
  • Cold-chain products: Medications requiring refrigeration or other special storage (e.g., insulin) cannot be returned once they have left our premises, due to the inability to verify storage conditions.
  • Dispensing errors: If we make an error in dispensing your prescription, please contact us immediately. We will correct the error at no additional cost and investigate the incident.

7. Prohibited Conduct

When using our services, you agree not to:

  • Present falsified, forged, altered, or stolen prescriptions
  • Attempt to obtain medications through deception, misrepresentation, or impersonation
  • Engage in drug diversion — obtaining medications for resale, redistribution, or supply to third parties
  • Harass, threaten, or abuse any member of our staff
  • Attempt to gain unauthorised access to our digital systems, patient records, or pharmacy management platform
  • Reproduce, copy, or distribute any materials, product information, or system content without our prior written consent
  • Use our services for any unlawful purpose or in violation of any applicable law or regulation of Cameroon

Violation of any of the above may result in refusal of service, permanent banning from our premises, and/or referral to law enforcement authorities.

8. Intellectual Property

All content, branding, logos, trademarks, text, images, software, and digital materials associated with Molua's Pharmacy are our exclusive property or are used under licence. This includes but is not limited to:

  • The "Molua's Pharmacy" name, logo, and associated marks
  • Our pharmacy management system and its interface
  • Marketing materials, patient information leaflets, and educational content

You may not use, reproduce, modify, or distribute any of our intellectual property without our express written permission. Any unauthorised use may give rise to legal claims.

9. Limitation of Liability

To the fullest extent permitted by applicable Cameroonian law:

  • Molua's Pharmacy will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services or products, even if we have been advised of the possibility of such damages.
  • Our total liability in connection with any claim relating to our services shall not exceed the amount you paid for the specific product or service giving rise to the claim.
  • We are not liable for adverse reactions, outcomes, or interactions arising from the use of medications dispensed strictly in accordance with a valid prescription from your licensed healthcare provider.
  • We are not responsible for damage arising from your failure to follow medication instructions, dosage guidance provided at the point of dispensing, or advice given by your prescriber.
  • Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Indemnification

You agree to indemnify, defend, and hold harmless Molua's Pharmacy, its staff, pharmacists, agents, and representatives from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your provision of false or misleading information; (c) your misuse of any medications dispensed to you; or (d) your violation of any applicable law or the rights of a third party.

11. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cameroon, including applicable pharmaceutical and health regulations.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall first be subject to good-faith negotiation between the parties. If the dispute is not resolved within 30 days of written notice, either party may pursue resolution through the competent courts of Cameroon.

Complaints regarding the professional conduct of our pharmacists may be submitted to the Ordre National des Pharmaciens du Cameroun (ONPC), which regulates pharmacy practice in Cameroon.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, provide notice via a sign in our pharmacy or an email to registered customers. Changes take effect immediately upon posting unless otherwise stated. Your continued use of our services after any changes constitutes your acceptance of the revised Terms. If you do not agree with the changes, please discontinue use of our services.
